Tenant Selection Criteria
Ironrock Properties
1. Introduction
This document outlines the criteria used by Ironrock Properties (“Landlord”) to evaluate rental applications. All applicants must meet these criteria to qualify for tenancy. These criteria comply with all applicable Texas state and federal fair housing laws.
This document is part of a suite of governing documents for Ironrock Properties, which includes our Privacy Policy and Terms of Use (collectively, the “Website Policies”). Each document is incorporated by reference into the others. 2. Non-Discrimination Policy
Ironrock Properties is committed to compliance with all federal and Texas fair housing laws. In accordance with the Federal Fair Housing Act (42 U.S.C. 3601 et seq., as amended) and Texas Fair Housing laws, Ironrock Properties does not discriminate against any person in the sale, rental, financing, or advertising of housing accommodations based on race, color, religion, sex, familial status, national origin, disability, or military status. Ironrock Properties will make reasonable accommodations for persons with disabilities and will consider reasonable modifications to the property when necessary to afford persons with disabilities full enjoyment of the premises.
3. Application Process
- Each prospective adult occupant (18 years or older) must submit a completed rental application and pay the non-refundable application fee.
- Ironrock Properties utilizes Propertyware.com as its application vendor for processing all rental applications. By submitting an application, applicants consent to the sharing of all application information with Propertyware.com for processing purposes. Propertyware is a product of RealPage, Inc. Tenant screening, including credit checks, criminal background checks, and rental history verification, is conducted through RealPage's LeasingDesk Screening, a Consumer Reporting Agency under the Fair Credit Reporting Act (FCRA). Credit reports may be obtained from Experian, Equifax, and/or TransUnion.
- Incomplete applications will not be processed until all required information is provided.
- Processing time is typically 1–3 business days from receipt of a complete application and all required documentation.
- Falsification of information on the application is grounds for denial.
4. Income Requirements
- Applicants must have verifiable gross monthly income of at least three (3) times the monthly rent amount.
- Income verification may include but is not limited to:
- Recent pay stubs (last 30 days)
- Employment verification letter on company letterhead
- Tax returns or W-2 forms for self-employed applicants
- Bank statements showing regular deposits
- Proof of government assistance, retirement, or investment income
5. Credit History
- A credit report will be obtained for all applicants through Propertyware.com.
- Negative credit history, collections, judgments, or bankruptcies may result in denial or additional requirements.
6. Rental History
- Applicants must provide verifiable rental history for the past 24 months.
- Negative rental history including but not limited to evictions, lease violations, property damage, or unpaid rent may result in denial.
7. Criminal History
- Criminal background checks will be conducted in compliance with Texas state and federal fair housing laws.
- Criminal history will be evaluated on a case-by-case basis considering factors including but not limited to the nature and severity of the crime, when it occurred, and evidence of rehabilitation.
8. Military Personnel Accommodations
In accordance with Texas law and the Servicemembers Civil Relief Act (SCRA), Ironrock Properties provides special considerations for active duty military personnel, including:
- Early lease termination rights for military personnel who receive permanent change of station orders or deployment orders for 90 days or more.
- Waiver of application fees for active duty military personnel upon presentation of valid military identification.
- Consideration of military housing allowances as income for qualification purposes.
- Recognition of power of attorney for military spouses when service member is deployed or on remote assignment.
- Expedited application processing for military personnel when possible.
9. Occupancy Standards
- Maximum occupancy is limited to two (2) persons per bedroom plus one (1) additional person per unit.
- Exceptions may be made to comply with fair housing laws.
10. Consent to Information Sharing
- By submitting an application, applicant consents to the sharing of all application information with the Landlord and its authorized representatives, including Propertyware.com.
- Applicant authorizes Landlord to verify all information provided, including but not limited to contacting current and previous landlords, employers, financial institutions, and credit reporting agencies.
- Applicant authorizes Landlord to keep and preserve all application records for at least four (4) years from the date of application, in accordance with the record-keeping requirements of the Texas Real Estate Commission (TREC) under the Texas Real Estate License Act and Texas Administrative Code Title 22, Part 23, Chapter 535.
11. Denial and Appeal Process
- If an application is denied, applicant will be notified in writing with the reason for denial.
- Applicant may appeal a denial by providing additional information or documentation addressing the reason for denial within five (5) business days of receiving notice.
